The present conditions apply exclusively to use of the fly-euroairport.com site, hereinafter referred to as the "Site", based on a price-comparison engine; they are distinct from the general conditions of sale for products presented by the Partners on the Site.

Use of www.fly-euroairport.com, that is to say the fact of examining the pages of the Site and taking cognizance of their content, implies unreserved acceptance by the Users of the present general conditions.

Basel-Mulhouse Airport, hereinafter referred to as the "Airport", reserves the right to alter the present general conditions at any time and without prior notice.

Notwithstanding the present general conditions, the Users promise to comply with the general conditions of each of the Partners.

The Partners are understood to be travel agencies and any operators having joined the Site and presenting offers of travel or related services, hereinafter designated as the "Products", departing from or arriving at Basel-Mulhouse Airport.

The present general conditions will become effective as soon as the Site becomes operational and any changes will become effective immediately after their publication on the Site.

The Airport, acting as an information intermediary and in particular allowing price comparisons, will display the Products offered by the sales Partners on the Site.

Products offered on the Site will be presented subject to availability from the Partners. The Airport, acting as an information intermediary, cannot accept responsibility for the availability of Products from the Partners.

The Airport does not sell, either directly or indirectly, the Products presented by the Partners. The Site allows examination of the Products; it does not allow either reservations or payments online which are effected directly on the Partners’ sites.

The Partners selling the Products presented on the Site shall handle the reservation and sale of their products in accordance with their own conditions of sale. The Airport will at no time intervene in transactions between Users and Partners, and more particularly not in the delivery of the Products.

The general and special conditions of sale, stating particularly the conditions for alteration or cancellation of reservations or orders, are those of each Partner.

Users are advised that they must enquire directly from the Site Partners and request their general and special conditions of sale for the Products presented on the Site.

The prices of the Products presented on the site Site are approximate retail prices. The Partners are alone responsible for the final selling prices charged to Users.

Any requests for information or complaints about the use of the Site should be addressed to the Site Contact section. These requests will be handled by the Site, provided that they involve the use of the Site.

Any complaints of a commercial nature concerning the sale of products presented on the Site should be addressed to the Partner concerned.

The Airport will, on the pages of the Site presenting the Products, reproduce the descriptions, photographs and illustrations submitted by the Partners.

The Airport will do its utmost to publish on the Site the descriptions, including any photographs and illustrations, submitted by the Partners or, if they are lacking, descriptions coming closest to those submitted by the Partners, in order to give the Users information that comes closest to the original descriptions of the Partners.

The descriptions, photographs and illustrations are not part of the contract and are not the responsibility of the Airport or its Partners.

The reproduction and/or representation and/or dissemination of the Site, total or partial, in any manner whatsoever and by any means whatsoever, of one or more of its elements (including the trademark "EuroAirport Basel-Mulhouse-Freiburg" and/or its logo, separately or together) without the previous written consent of the Airport is prohibited.

Failure to observe the rules referred to hereinabove shall constitute an infringement of copyright capable of involving the penal and/or civil responsibility of its author or authors. The Airport reserves the right to take any penal or civil action against them.

No hypertext link to the Site may be created without the previous written consent of the Airport. Requests should be addressed to the Site Contact section.

Failure by the Airport to contest hypertext links installed without the Airport’s previous written consent does not imply the consent of the Airport, which reserves the right to request their deletion at any moment.

In permitting access to the Site, the Airport grants Users only a right to non-collective and non-exclusive private use of the contents of the Site.

All rights of reproduction are reserved, including of downloadable documents and photographic and iconographic representations.

Any connection to a network, any dissemination or redissemination, any reproduction of all or part of the contents of this Site, in any form whatsoever, even partial, or on any electronic medium whatsoever is formally prohibited, except with the previous written authorization of the Airport.

Reproduction of the texts of the Site is authorized only on a paper medium, provided that the following cumulative conditions are fulfilled:

• the dissemination must be gratuitous: the document may be used only for information and for a non-lucrative purpose;

The information contained on the Site is given purely for information purposes and has no contractual value. The Airport does not guarantee either the accuracy of the information or the products presented on the Site. The information may undergo changes and/or revisions without prior notice.

The Airport guarantees neither the availability of the Site, nor its proper functioning, nor its compatibility with all of the Users’ hardware and software.

The Airport may in no event be held responsible for damage or prejudice of any nature whatsoever suffered by Users on account of or in connection with:

• the contents and/or use of the Site,
• the contents and/or use of Internet sites linked to the Site or to which users might gain access via the Site,
• the impossibility of gaining access to or using of the Site,
• omissions, alterations and/or updates of the Site.

The Airport cannot be held responsible for any invalidity, inaccuracy or changes of the proposed hypertext links or of the contents of the Site or sites to which Users are redirected.

The Airport as an information intermediary may in no event be held responsible for damage due to or in connection with the signature or execution of contracts of sale or the provision of service, whether or not they have been concluded between Users and Partners.

The Users expressly declare that they are aware of the characteristics and limitations of the Internet and particularly its technical performances, the response times for consulting, querying or transferring data and the risks inherent in communications safety.

The Site is published by Basel-Mulhouse Airport, a Franco-Swiss public enterprise governed by the international convention of 4 July 1949 concerning its construction and operation and the headquarters of which are situated at 68730 Blotzheim, France.

The personal information collected during registration of the Users on the Site for the creation of "My Space" will be processed automatically. This has been announced to the CNIL (Commission Nationale de l’Informatique et des Libertés).

The personal information requested by e-mail or by means of a form is intended for the Airport and its Partners.

Obligatory and indispensable information required by the Site to handle and comply with Users’ requests is marked with an asterisk on the pages of the Site. The other information requested is optional and intended to provide a better knowledge of the Users taking advantage of the "My Space" section.

In accordance with law No 78-17 of 6 January 1978, amended by law No 2004-801 of 6 August 2004, Users will have a right to access, rectification and deletion of data concerning them individually (art. 34 of the amended law No 78-17 of 6 January 1978).
